Article 1. Service provider and contact
The service provider is DRAGO TOURS Limited Liability Company for Catering and Travel Agency, abbreviated as DRAGO TOURS d.o.o., Riječka 31, HR-52465 Tar, Croatia, VAT-ID: HR32829482970, MBS: 040337208.
Contact for reservations and written complaints: info@drago-tours.hr; phone: +385 91 541 9141; website: www.drago-tours.hr.
Article 2. Scope
These General Terms and Conditions of Business regulate the relationship between Drago Tours and the person contracting an independent accommodation service in a tent or other Drago Tours accommodation unit within the campsite specified in the booking confirmation, including Lanterna Premium Camping Resort.
These terms constitute an integral part of the offer and booking confirmation. Special terms specified in a particular offer or booking confirmation take precedence if they are clearly presented to the guest before the contract is concluded. The rules and house regulations of the campsite operator apply additionally during the stay.
Article 3. Booking and conclusion of the contract
A reservation request can be submitted via the website, e-mail, telephone, booking portal, or an authorized sales partner. The request itself or an automatic acknowledgment of receipt does not constitute a confirmed reservation.
The reservation becomes final, and the contract is concluded when Drago Tours sends a written confirmation of the reservation and receives the agreed deposit within the prescribed period, unless explicitly stated otherwise in the confirmation. The guest is obliged to immediately check the names, dates, type of accommodation, number of persons, price, and additional services, and to report any inaccuracies without delay.
Obvious printing, calculation, or technical errors that an average guest could recognize are not binding. If an error significantly affects the price or content of the reservation, Drago Tours will offer a correction, an appropriate alternative, or free cancellation with a refund of received payments.
Article 4. Booking holder and guests
The reservation holder must be at least 18 years old and is responsible for the accuracy of the submitted information, all payments, and the behavior of all registered persons. All communication is conducted with the reservation holder.
Only persons listed in the reservation may stay in the accommodation, and only up to the capacity specified in the unit description. An additional tent, extra persons, or unregistered visitors are permitted only with prior written consent from Drago Tours and the camp operator, and may be subject to an extra charge.
Drago Tours may refuse group reservations or reservations that, due to composition, age, or purpose of stay, are not suitable for family camping. Minors may not stay without a responsible adult, unless Drago Tours exceptionally and in writing agrees to a different arrangement.
Article 5. Prices, included services and additional costs
Prices are expressed in euros, per accommodation unit and per night, unless otherwise stated in the offer. The confirmed price includes accommodation up to the allowed capacity, consumption of water, gas, and electricity, use of air conditioning and television if included in the selected unit, and one parking space according to the campsite's rules and availability.
Tourist tax and other mandatory local charges are not included unless explicitly stated otherwise in the confirmation. These charges are payable to the campsite operator or another designated recipient according to applicable regulations and price lists.
Final cleaning, bed linen, towels, baby cot and high chair, as well as other additional services, are charged according to the applicable price list and reservation confirmation. Discounts and last-minute offers published subsequently do not entitle a reduction of the already confirmed price. Discounts are not cumulative unless explicitly permitted.
Article 6. Payment terms
The advance payment amounts to 30% of the total agreed price and must be paid within 7 days of the reservation, unless otherwise agreed.
The remaining 70% must be received no later than 42 days before arrival, unless otherwise agreed.
For a reservation made 42 days or less before arrival, the full amount must be paid immediately, within the period specified in the confirmation.
Bank transaction fees are borne by the payer. If the payment is not received on time, Drago Tours may send a written reminder and grant an additional period of 3 days. If payment is still not received, the reservation may be cancelled, and a fee applicable on the date of cancellation will be charged.
Article 7. Cancellation by the guest
Cancellation must be submitted in writing to info@drago-tours.hr. The relevant date is the day on which Drago Tours receives an unequivocal written notice. The number of days is calculated between the day of receipt of the cancellation and the agreed day of arrival, with the day of arrival not being counted.
For accommodation booked for a specific date or period, the usual fourteen-day right to unilateral withdrawal from a contract concluded at a distance does not apply. The following agreed cancellation terms apply:
| Time of receipt of cancellation | Cancellation fee |
|---|---|
| More than 60 days before arrival | no fee |
| From 60 to 43 days before arrival | 20% of the total price |
| From 42 to 29 days before arrival | 60% of the total price |
| From 28 to 8 days before arrival | 90% of the total price |
| 7 days or less before arrival | 100% of the total price |
| On the day of arrival, no-show, or after the start of the stay | 100% of the total price |
If the guest has paid more than the applicable fee, the difference will be returned without undue delay, usually within 14 days from the final invoice. Travel insurance costs and services already rendered are non-refundable. It is recommended to arrange appropriate travel insurance.
Stricter conditions may apply for a specially marked non-refundable rate or promotional offer, but only if clearly presented to the guest before booking and stated in the confirmation.
Article 8. Changes to the booking
The reservation holder may request a change of date, duration, type of accommodation, or guest composition. Changes are only possible with the written confirmation of Drago Tours, availability of capacity, and approval of the campsite operator.
For an approved change requested at least 60 days before arrival, an administrative fee of €25 will be charged, as well as any possible difference in price. If the new stay is more expensive, the guest pays the difference. If it is cheaper or the stay is shortened, the reduction is considered a partial cancellation and the cancellation percentage valid on the day of the request applies.
A change to the next calendar year is not guaranteed. Extending the stay during the holiday is possible only if accommodation is available and is charged at the price valid on the day of extension, without entitlement to previous discounts.
Article 9. Changes or cancellation by Drago Tours
If Drago Tours is unable to provide the contracted accommodation due to unforeseen circumstances, it will promptly offer the guest equivalent or better accommodation at no additional charge. If a suitable replacement is not available or is reasonably not accepted by the guest, Drago Tours will refund the amounts paid for the service that will not be provided.
Drago Tours may make a minor change before arrival that does not materially diminish the value or main features of the booking. The guest will be informed of any significant change as soon as possible and will be able to accept the change, choose the offered replacement, or terminate the contract with a refund of the relevant payment.
Article 10. Arrival, departure, late arrival and no-show
Accommodation is available on the day of arrival from 16:00 to 20:00, and on the day of departure it must be vacated no later than 10:00, unless otherwise stated in the reservation confirmation. Arrival and departure days depend on the period, the selected offer, and availability.
A guest expecting to arrive after 20:00 must contact Drago Tours in advance. Without prior notice, accommodation is held until 10:00 the following day, after which the reservation may be considered a no-show and the unit may be offered to another guest.
Late arrival, early departure, no-show, or voluntary termination of an already started stay does not entitle the guest to a refund of the unused portion of the price. Late departure is allowed only by prior arrangement and may incur an additional charge.
Article 11. Allocation of accommodation and special requests
Photographs, floor plans, and descriptions depict the type and general standard of accommodation. Individual units and plots may differ in location, size, orientation, vegetation, layout, and minor details of equipment, without reducing the contracted category and basic amenities.
Requests such as a specific plot, shade, proximity to facilities, or accommodation of multiple families nearby are considered but are not guaranteed unless explicitly confirmed in writing by Drago Tours as a paid or complimentary guarantee.
Guests must notify in writing before booking any needs related to reduced mobility, allergies, or other important circumstances. Drago Tours will confirm whether they can reasonably accommodate them.
Article 12. Use of accommodation and house rules
Accommodation is used exclusively for the rest of registered guests. Subletting, business use, organizing parties, disturbing other guests, moving inventory outside its intended purpose, or any other use contrary to the campsite rules is not permitted.
Smoking is prohibited in all accommodation units. Pets are not allowed unless Drago Tours has explicitly confirmed an exception in writing prior to the reservation.
Guests must comply with the house rules, nighttime quiet hours, safety instructions, and the orders of authorized Drago Tours staff and campsite operators. In the event of serious or repeated violations, particularly those endangering safety, accommodation may be canceled and the guest removed after a warning, or immediately if necessary to protect persons or property. In such cases, there will be no refund for the unused portion of the stay, without affecting rights that by law cannot be excluded.
Article 13. Cleaning, additional equipment and inventory
Final cleaning can be booked for an additional fee of €75, unless the booking confirmation states that it is included or mandatory. Even when cleaning is booked, the guest must remove food, empty the refrigerator, wash and dry the dishes, take out the trash, and clean the barbecue before departure.
If final cleaning is not booked, the guest must return the accommodation clean and thoroughly tidy. The cost of extraordinary cleaning, removal of smoke, stains, waste, or other contamination may be charged according to the actual work and materials required.
Bed linen, towels, a crib, a high chair, and other equipment are available upon prior reservation, according to the current price list and availability. The guest must immediately report any shortage or damage to the inventory upon arrival.
Article 14. Security deposit and compensation for damage
Upon arrival, a security deposit of €100 per accommodation unit may be required, payable in cash, by credit card pre-authorization, or by another method specified in the confirmation. The deposit will be returned after the accommodation has been inspected, provided that the unit and its inventory are handed over in order, without unreported damage or loss.
The guest is responsible for any damage, loss, or excessive contamination caused by them, a member of their group, a visitor, or a person for whom they are responsible. Drago Tours may deduct documented reasonable costs for repair, replacement, cleaning, or lost keys from the deposit. If the cost exceeds the deposit, the guest is obliged to pay the difference; if it is less, the remainder will be returned.
Any malfunction, leak, damage, gas smell, or other safety issue must be reported immediately. The guest must not carry out repairs themselves nor call a third party at Drago Tours' expense without prior consent, except when it is necessary to prevent imminent serious damage.
Article 15. Air conditioning, barbecue and safety
The air conditioning unit may be used reasonably and according to the instructions. Guests must not cover the unit or alter the installations.
Only the use of a barbecue that complies with the campsite rules is allowed. The barbecue must be used outdoors, on a stable surface, under the constant supervision of an adult, and away from flammable materials. The guest must comply with any temporary ban on barbecuing due to wind, drought, fire danger, or orders from the competent authorities or the campsite operator.
Open flames, candles, improvised cooking appliances, and charging an electric vehicle from the accommodation installation are not permitted. The guest is responsible for any damage caused by improper or prohibited use of equipment.
Article 16. Campsite, shared facilities and third parties
Drago Tours is responsible for the booked accommodation and equipment under its management. The campsite operator and other providers manage the reception, swimming pools, beach, sanitary and sports facilities, entertainment, shops, restaurants, parking lots, internet access, and other shared services.
The working hours, availability, and prices of campsite facilities may change due to the season, maintenance, weather conditions, safety reasons, or the operator's decision. Drago Tours is not responsible for such changes when they were not caused by it nor could reasonably have been prevented by it, but it will provide the guest with available information and assistance in communicating with the responsible provider.
One vehicle is generally included in the reservation according to campsite rules, but the parking space does not have to be directly next to the accommodation. Additional vehicles, boats, trailers, or visitors may be subject to approval and fees by the campsite operator.
Article 17. Service deficiencies and written complaints
The guest must report any deficiency to the local representative of Drago Tours immediately after noticing it and allow a reasonable period for inspection and rectification. If the issue is not resolved, the guest should promptly contact the Drago Tours office via phone or email. Failure to report during the stay may be taken into account when assessing the claim to the extent that it prevented timely resolution of the problem.
A written complaint may be sent by email to info@drago-tours.hr or by mail to DRAGO TOURS d.o.o., Riječka 31, HR-52465 Tar, Croatia. It is recommended to include the reservation number, description of the event, date, photographs or other documentation, and the requested resolution.
Drago Tours will acknowledge receipt when necessary and respond in writing no later than 15 days from the receipt of the complaint, clearly indicating whether it accepts its validity. Records of written complaints are kept on a permanent medium for at least one year from the date of receipt.
Article 18. Liability and extraordinary circumstances
Drago Tours is responsible for the proper provision of the contracted accommodation service in accordance with applicable regulations. The guest is responsible for their own belongings and it is recommended that valuables be kept safe and that the camp safe be used if available.
Drago Tours shall not be liable for loss or damage resulting from the actions of the guest, persons in their group, an independent third party, failure to follow instructions, or circumstances beyond reasonable control, such as extreme weather, natural disasters, war, unrest, epidemic measures, disruption of public infrastructure, construction, noise, pests, or decisions of the competent authority, except to the extent that liability cannot be excluded under mandatory law.
If, due to extraordinary circumstances, Drago Tours is objectively unable to provide the agreed accommodation, it will offer a reasonable substitute, change of dates, or a refund for the unprovided service. If accommodation is available but the guest cannot attend due to personal circumstances or travel difficulties, the cancellation terms apply, unless the parties agree otherwise in writing.
Nothing in these terms excludes or limits liability for intent, gross negligence, injury to life or health, or any other right that cannot be excluded or limited under the law.
Article 19. Personal data
Drago Tours processes personal data necessary for booking, payment, guest registration, providing assistance, security, and compliance with legal obligations. Necessary data may be provided to the campsite operator, competent authorities, payment service providers, IT service providers, or sales partners to the extent required to carry out the booking.
Data are used for direct marketing only when there is a valid legal basis, including consent when required. Details on processing, retention periods, and data subject rights are governed by a separate Privacy Policy published on the Drago Tours website.
Article 20. Governing law and final provisions
The contract is governed by the law of the Republic of Croatia, with respect to mandatory consumer rights applicable under European Union law or the law of the guest's habitual residence. The parties shall primarily attempt to resolve disputes through agreement and a written complaint procedure; if this is not possible, jurisdiction is determined according to the applicable regulations.
If any provision is null or unenforceable, the remaining provisions shall remain in effect, and the invalid provision shall be replaced by a permissible provision closest to its lawful purpose.
Drago Tours may amend these terms for future bookings. For an already confirmed booking, the version provided or available to the guest at the time of contract conclusion shall apply, except for amendments that are more favorable to the guest or mandatory by law. Translations are provided for the guest's easier understanding; the Croatian version is the reference, without prejudice to mandatory consumer rights.
